Terms of Service | PainMiner

These terms are a binding agreement between you and DDMarketing Agency ("we", "us"), represented by Daniel Hansen, governing your use of PainMiner ("the Service"). By creating an account or purchasing a subscription you accept them. Contact: legal@ddmarketing.com.

1. The Service

PainMiner aggregates and analyzes publicly available internet complaints to surface potential software opportunities, with scores, briefs, and validation material. The data is provided for research and inspiration. We make no promise, guarantee, or representation that any opportunity in the Service will be commercially viable, accurate, complete, or suitable for your purposes. Scores and briefs are automated analytical outputs that pass an editorial quality gate; they are not professional, financial, legal, or investment advice. Building a business involves risk that is entirely yours.

2. Accounts

You must provide accurate information, keep your credentials secure, and be at least 18 years old. You are responsible for activity under your account. One account per person; accounts may not be shared, resold, or pooled to circumvent plan limits.

3. Subscriptions and billing

Paid plans are billed by Lemon Squeezy as merchant of record on a recurring monthly basis at the price shown at checkout, plus any applicable taxes they collect. Plan features and limits are described on the pricing page. We may change prices for future billing periods with at least 14 days' notice; your then-current period is never repriced retroactively. Cancellation and refunds are governed by the Refund & Cancellation Policy.

4. Acceptable use

You may use exported data (CSV, PDF, white-label dossiers) in your own work and client deliverables. You may not: resell, redistribute, or republish the database or any substantial part of it as a competing dataset or product; scrape, bulk-download, or programmatically extract the Service beyond your plan's features; share login sessions to evade limits; reverse-engineer the Service; or use it for unlawful purposes. We may suspend or terminate accounts that violate these terms, with a refund of any unused full billing period in cases of our error, and without refund in cases of abuse.

5. Intellectual property

The Service, its design, software, scores, briefs, and curation are our intellectual property or licensed to us. Underlying public complaints remain the property of their authors and platforms; the Service links to original sources and quotes minimally. Your white-label exports may carry your branding, but the underlying analytical content remains licensed to you, not sold.

6. Disclaimers and liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, and our total aggregate liability for any claim arising from the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.

7. Termination

You may delete your account at any time in Settings; we may terminate accounts for breach as described above. Sections 5-8 survive termination.

8. Governing law and changes

These terms are governed by the laws of the jurisdiction in which DDMarketing Agency is established, without regard to conflict-of-law rules; consumers retain any mandatory protections of their country of residence. We may update these terms; material changes will be posted here with an updated date, and continued use constitutes acceptance.
